1. Acceptance of Terms

By accessing or using the services of botsdontsleep.ai ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Services

botsdontsleep.ai provides AI voice receptionist software that answers, qualifies, books, and routes phone calls for business customers, along with related dashboards, transcripts, and integrations.

3. Accounts

You must provide accurate account information and are responsible for all activity under your account. Keep your credentials secure and notify us of any unauthorized use.

4. Acceptable Use

You agree not to use the service to:

• Place or receive calls in violation of TCPA, CASL, GDPR, or other applicable telecommunications and privacy laws
• Impersonate a person or business you do not represent
• Send unsolicited marketing, robocalls, or spam
• Reverse engineer, scrape, or attempt to extract underlying models or training data
• Interfere with, disrupt, or attempt to gain unauthorized access to the service
• Use the service for any unlawful, fraudulent, or harmful purpose

5. Customer Responsibilities

• Provide accurate business, intake, and routing information used to configure the AI
• Disclose call recording to callers as required by law in the jurisdictions you operate in
• Obtain any consents required from your callers, employees, and clients
• Review AI-handled calls periodically and correct scripts as needed

6. Fees and Payment

• Subscription and usage fees are billed as described on our pricing page or in your order form
• Fees are non-refundable except as required by law or expressly stated
• Late payments may result in suspension of service and additional charges
• We may change pricing on renewal with reasonable prior notice

7. AI Output Disclaimer

The service uses artificial intelligence to answer calls, generate transcripts, and summarize conversations. AI output may contain errors or omissions. You are responsible for reviewing critical AI-handled interactions and should not rely on AI output as legal, medical, or financial advice.

8. Confidentiality

We keep customer configuration, call recordings, and caller data confidential and share them only as described in our Privacy Policy or as required by law.

9. Intellectual Property

The service, including software, models, dashboards, brand marks, and documentation, is owned by botsdontsleep.ai and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain ownership of your business content and call data.

Prohibited without written permission: automated scraping of our site, using our content to train third-party AI models, resale, and creation of derivative products.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim related to the service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages.

11. Warranty Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Suspension and Termination

We may suspend or terminate the service for material breach of these terms, non-payment, or abuse. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

13. Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control, including outages of upstream telephony, model, or cloud providers.

14. Governing Law and Disputes

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Ontario or, at our option, by binding arbitration.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated effective date; continued use of the service constitutes acceptance.
